Gilpin Commissioners review permit application

The Gilpin County Commissioners meeting was called to order by Commissioner Buddy Schmalz at the Gilpin County Courthouse May 10, 2016 at 9 a.m. along with Commissioner Gail Watson. Commissioner Isenhart was excused for jury duty. Also in attendance were County Manager Roger Baker, County Attorney Jim Petrock, and Deputy Clerk to the Board Sharon Cate.

BMX Course Proposal

CSU Extension Agent Dr. Irene Shonle presented a proposal to construct a BMX track at the Gilpin County Fairgrounds. Numerous Gilpin County youth have expressed interest in and helping build a BMX track. This is a joint effort by the Extension office, Gilpin County Fair, and the youth of Gilpin County. Gilpin County Public Works and Gilpin County Fair BMX superintendents have also agreed to assist. The location will be located at the northwest corner of the Fairgrounds. Riders will be required to wear the appropriate safety gear and will be monitored by the Extension Office and Community Center personnel to ensure that all the rules are enforced. This proposal was approved.

New Ambulance Inspection and Licensing

Gilpin County Ambulance Authority has acquired a new ambulance #114 (Medic 2) which will replace the older #110 (Medic 2). The 2016 Ford F-450 will need to be inspected and licensed before being put into service. The Board approved this action and soon there will be a modern addition to the Gilpin County Ambulance Authority fleet.

Boundary line Adjustment

Tony Petersen presented a Boundary Line Adjustment (BLA) for a property located on Robinson Hill Road. Parcel 1 (SBE 06-04) 26.14 ac will be adjusted to create Parcel 1A and a portion of NW 1/4 of the NW 1/4, Section 13 will be Identified as Lot 8B containing 8.804 ac. The smaller of the two parcels is currently land locked, leaving no access. This BLA would reconfigure the parcels giving both of them access to Robinson Hill Road.

Weirdos in the Woods

Tony Petersen presented the Gilpin County Commissioners an Application for a Temporary Use Permit (TUP) (TUP 16-01) for “Weirdos in the Woods Gathering.” The applicant, Weirdo Productions LLC, requested to obtain a permit for a three-day music festival with camping, art displays, yoga and New Age workshops. The location will be in the Missouri Gulch (Wideawake) area at Uncle Charlie’s Place. 500 participants are expected to attend the July 22nd thru 24th event. Parking is limited so attendees will be bussed in from the Nevadaville Road parking area. On-site sanitation, security, and emergency services will be provided through various pending contractual agreements. One of the biggest concerns that the Commissioners have is access to the area. Missouri Gulch Road is not wide enough to accommodate this type of venue. Emergency response vehicles will have to compete with evacuation operations on a single lane road in a Mass Causality Incident (MCI) or Wildfire event. Noise was another concern of the Commissioners, the promoters were clear that amplified music will be playing until 2 a.m. Saturday and Sunday mornings.

Gilpin County Commissioners requested more time to tabletop and study this permit application – in the meantime the applicants are to meet with Gilpin County Sherriff’s Department, Timberline Fire District, Gilpin County Health, Gilpin County Ambulance Authority, and Central City officials to review the details surrounding this event and obtain approval. This application will be added to the Gilpin County Commissioners Meeting agenda on May 24, 2016.

Deed Exchange

Tony Petersen presented a Deed Exchange for properties located on South Beaver Road. Without the benefit of a building permit, the applicant inadvertently constructed a garage approximately 6 feet into the platted right of way of Wallen’s Place. County commissioners conveyed approximately 350 square feet of Wallen’s Place right-of-way to the applicant. The property that was conveyed will protrude approximately 10 feet into the existing right-of-way. This protrusion would not affect the existing travel on Wallen’s Place. The Deed Exchange was approved.

Water Rights Lease

Gilpin owns four inches of Church Ditch water feed rights which will be leased to Gary Gambino for irrigation. Gilpin’s four inches will not be needed in 2016 for County purposes. The Church Ditch lease was approved

County Manager Report

County manager Roger Baker reported that Gilpin County Jail attendance was down last month from the March totals. April saw 107 inmates in detention, whereas 112 inmates were held in March.

Legal Status Report

County Attorney Jim Petrock reported to the Gilpin County Commissioners about an article in the Weekly-Register-Call (May 5, 2016) by Dr. Irene Shonle, titled “Water barrels for collecting rain water will soon be legal.” HB 16-1005 passed the State House and Senate and will expected to be signed by Governor Hickenlooper and will be in effect August 10, 2016. Petrock emphasized the residents will be able to collect 110 gallons of run-off per event (i.e., a rain or snow storm).

The next Gilpin County Board of Commissioners meeting will be May 24, 2016, 9 a.m. at the Gilpin County Courthouse at 203 Eureka St. Central City, Colorado.
