Gilpin County to spend $1.3 million on renovating new Public Health/ Human Services facility

Water use in residential subdivisions designated for household only, not for domestic livestock

The Gilpin County Board of County Commissioners (BOCC) opened up their Regular meeting at 9:01 a.m. on Wednesday June 25, 2019, at the Historic Gilpin County Courthouse. Present were Commissioner Chair Linda Isenhart with Commissioners Ron Engels and Gail Watson. Also present County Attorney Bradford (Brad) Benning and Deputy Clerk to the Board Sharon Cate. County Manager Abel Montoya was absent.

Blue Sky Contract

Gilpin County Commissioners approved the Design-Build contract with Blue Sky Builders LLC for the renovation of the new Public Health/ Human Services Building located at 15193 Hwy 119 (Former Renaissance Solutions building). The contract total cost to the County will be $1,289,239.

Boundary Line Elimination

Gilpin County Community Planner Danial Horn presented a Boundary Line Elimination (BLE #19-03) on behalf of Brandy Hale on Morning Star Circle. The applicant requested that boundary line be eliminated between Lot 8 and Lot 31 in the Mountain Meadows Subdivision to form Lot 8A which will consist of 1.3 acres of improved land. BLE #19-03 was unanimously approved by the Commissioners.

Boundary Line Adjustments

Gilpin County Community Planner Danial Horn presented a Boundary Line Adjustment (BLA 18-05) on behalf of Ty Mattern on Lodge Pole Lane. The applicant requested that boundary line be adjusted on Parcel 1, 2, and 4 to form Parcel 1A, 2A, and 4A respective. BLE 97-03 was applied for by Harvey Stitt and had been approved to combine seven lots in Block 5 of Missouri Lakes Filing #2 to form one large lot of 7.89 acres. In 1997 Harvey and his son James Stitt co-owned the seven lots in question, but because James’ signature was not on the BLE application, he was of the opinion that BLE 97-03 was approved in error. Based on that opinion, James Stitt petitioned the BOCC to rescind the decision of those proceedings. Through negotiations Harvey agreed to divide Block 5 into 5 lots of 1.6 acres each. BLA 18-05 will keep all five lots but with adjusted property lines. After some discussion, BLE #18-05 was unanimously approved by the Commissioners.

Board of Adjustments Public Hearing

Gilpin County Community Planner Danial Horn also presented to the Board of Adjustment variance request (BOA 19-01) on behalf of James and Susan Modisher of North Dory Lakes Drive. The applicant requested the variance to reduce the set-backs for their new garage from thirty feet to eighteen feet due to the narrowness of their lot. The set-back code in Dory lakes is fifteen feet but County regulations takes precedence over sub-division codes. Gilpin County Commissioners were split two to one and BOA 19-01 was denied.

Local Landmark Designation

Gilpin County Community Development Director Stephan Strohminger presented an application for a Local Landmark designation for the Frontenac Mine Headframe. Robert Young Jr representing Elk Horn Investments, owners of the Frontenac Headframe and Shaft house on Pewabic Mountain, has submitted a building permit application to re-roof the Frontenac Headframe and Shaft house in order to initiate the process of landmark designation for the property. The application for Landmark designation was considered at the April 25, 2019 meeting of the Historical Preservation Advisory Commission (HAC) meeting. HAC found that the property is eligible for landmark designation based on certain criteria and unanimously approved the request for designation. Commissioner Engels made a motion to approve the Landmark Designation, Commissioner Watson seconded the motion, and the designation was approved unanimously.

Evacuation Route Survey

Gilpin County Community Development Director Stephan Strohminger presented an Emergency Evacuation Route Survey from Flatirons Inc. for land located in the Wedgewood/ La Chula area. The Evacuation Route easement will be situated between Lupine Place and Stone Road. Total cost of the survey will cost Gilpin County $5,585. After some discussion it was revealed that the owner of the lower property near Stone Road has not granted their formal permission for an evacuation route through their property. With that on the table, Gilpin County Commissioners decided to postpone the vote for the survey request until formal permission is obtained.

Liquor License Renewal   

Madam Chair Isenhart adjourned the commissioners meeting at 10:07 a.m. and opened the Local Liquor Licensing Board to review the Retail Liquor License Renewal Application for Underground Liquors at 15107 Highway 119, Black Hawk, Colo. presented by Deputy Clerk to the Board, Sharon Cate. The Board reviewed the application and approved the renewal unanimously. Isenhart adjourned the Local Liquor Licensing Board and re-opened the Regular Gilpin County Commissioners Meeting at 10:10 a.m.

Clerk and Recorder’s Report

Gilpin County Clerk and Recorder Sahari McCormick and Chief Deputy Clerk Elaine Lewers presented the Clerk and Recorder’s monthly report for the months of February and March 2019. In the report it is noted that 2019 “Funds Collected” in February are down $17,000 from the February 2018 numbers. Funds Collected in March 2019 also saw a $21,000 reduction from March 2018. Ms. McCormick explained that these reductions are dependent mainly on the purchase of new cars by county residents.

2020 Census Informational Item

Sahari McCormick introduced Census Partnership Specialists Jennifer Pool Radway from The Complete Count Committee to the Commissioners. Ms. Radway presented a plan that will encourage maximum participation for the Census. She informed the Commissioners that the Census drives more than $13 billion dollars in Federal funds annually into Colorado and participation should be encouraged at all levels of government.

Legal Status Report

Gilpin County Attorney Bradford (Brad) Benning reported that their office has been busy with contract matters such as the Blue Sky Contract, the Excel Contract, and a minor adjustment on the bond with Excel that was required for Road and Bridge. He also emphasized that when residents are in a subdivision, they are subject to the State’s regulation on water well use. If smaller than 35 acres the well is classified as “Household Only.” If 35 acres or more the well can be classified as “Domestic” which will allow the resident to provide water to domestic livestock and irrigation of up to one acre.

Planning Commission Appointment

Gilpin County Commissioners appointed Shannon Arrington to the Gilpin County Planning Commission.

Meeting Minutes

Gilpin County Commissioners approved the minutes from the May 21, 2019 regular meeting and the June 11, 2019 regular meeting with some corrections.

Executive Session

The BOCC adjourned to Executive Session to perform County Manager Montoya’s annual review per the appropriate Colorado Revised Statutes 24-6-402(4),(f)(I) & (II).

Sport Shooting Range Community Meeting

The US Forest Service Dispersed Shooting Decision was published in the Weekly Register-Call last week, but will be discussed at a Community Meeting on Thursday July 18, 2019 between 6:00 and 7:00 p.m. at the Community Center located at 250 Norton Drive.
